TERMS AND CONDITIONS OF THE “SHARE CREATIVE MOMENTS” CAMPAIGN
1.1. These Terms and Conditions define the rules and conditions for participation in the campaign organized by Prosker Sp. z o.o., located in Płock, 09-400 at Kostrogaj Street 9D, Tax Identification Number: 774 321 07 15, REGON: 14585516, conducted on the company’s profiles (hereinafter referred to as the Pages):

1.2. Terms used in these Terms and Conditions mean:
- Campaign – the “Share creative moments” campaign organized by Prosker Sp. z o.o.;
- Task – a task that must be completed to receive a Reward;
- Participant – a person who meets the conditions set out in these Terms and Conditions;
- Organizer – Prosker Sp. z o.o. company organizing this campaign (also known as “CottonBee”);
- Awarded – Participant who completes the Task based on the rules set out in §3 of these Terms and Conditions.
1.3. The Campaign will be conducted from January 18, 2024, until further notice.
1.4. To participate in the Campaign, it is required to correctly complete the Task specified in the initiating post (“Post”) on the Pages and in §3 of these Terms and Conditions.
1.5. Participation in the Campaign means acceptance of the Campaign conditions specified in these Terms and Conditions, including consent to the processing of personal data of the Participant by the Organizer to the extent and on the terms specified in these Terms and Conditions.
1.6. The Campaign is in no way sponsored, endorsed, managed, or associated with Instagram and Facebook.
1.7. Instagram is not responsible for the proper conduct of the Campaign. Any claims related to the Campaign should be directed only to the Organizer.
1.8. The Organizer declares that the Campaign is not a game of chance, a phantom lottery, a mutual bet, a promotional lottery, a game whose outcome depends on chance, nor any other form as provided in the Act of November 19, 2009, on gambling (Journal of Laws of 2009, No. 201, item 1540 as amended).
- 2. PARTICIPATION IN THE CAMPAIGN
2.1. Detailed information about the rules of participation in the Campaign and its course is provided to the Participants in these Terms and Conditions and in the Post on the Pages.
2.2. By participating in the Campaign, the Participant expresses their acceptance of the provisions of these Terms and Conditions.
2.3. Participation in the Campaign is voluntary and free of charge.
2.4. Only individuals residing in the territory of the European Union, who are at least 18 years old or have the consent of their legal representative to participate in the Campaign, can be Participants. Partially incapacitated participants may take part in the Campaign only after obtaining consent from their legal guardian.
2.5. Employees of CottonBee and other persons indirectly or directly related to the organization of the Campaign cannot participate.
2.6. Participants who provide false or incorrect information about themselves or enroll other people will not receive a reward.
2.7. If it is determined that a Participant does not meet any of the conditions set out in these Terms and Conditions, they will be excluded from the Campaign and will lose any right to a reward in the Campaign.
- 3. CONDUCT OF THE CAMPAIGN
3.1. The Task involves:
- printing any material at CottonBee
- creating something unique from it: from accessories to clothing
- posting a photo of their work on Instagram with the hashtag #CottonBeeDIY and tagging our profile
3.2. Each Participant can add many photos during the Campaign, but it is stipulated that a Participant can only receive one Reward for a specific sewing project – regardless of how many photos with the same project the Participant has published.
3.3. Participants impersonating third parties to increase their chances in the Campaign or persons copying and using the works or image of third parties, especially for the purpose mentioned above, will be automatically removed from participation in the Campaign, and their data will be blocked in future initiatives of the Organizer.
3.4. Submissions containing terms or phrases commonly considered vulgar or offensive or infringing on personal goods or exclusive rights of third parties will not be considered in the Campaign.
3.5. Every Participant of the Campaign who correctly completes the Task specified in §3.1 will be rewarded.
3.6. Participation in the Campaign by a Participant is equivalent to a declaration that they hold the copyright to the published photo, that it does not violate the rights of third parties, and that the photo has not been previously published elsewhere.
- 4. REWARDS
4.1. The reward in the Campaign is a 20% discount on the next order from 1 to 9 meters at CottonBee.
4.2. The awarded will be informed about the awarded Reward by the Campaign Organizer through a private message on Instagram.
4.3. Rewards will be given to the awarded no later than within 15 working days from the date of publishing the photo on Instagram.
4.4. A Campaign Participant cannot exchange the Reward for cash or transfer the right to receive the Reward to third parties.
4.5. Code applies to orders of 1 to 9 metres. Discount cannot be combined with other offers.
- 5. COMPLAINT PROCEDURE
5.1. Questions, complaints, and claims regarding the conduct of the Campaign should be directed to the address: [email protected]. Complaints that are received no later than within 3 days from the day of the occurrence or event that caused the complaint will be considered by the Organizer.
5.2. Only Participants of the Campaign are entitled to file a complaint.
5.3. Complaints will be considered by the Organizer within 7 working days from the date of delivery of the message. The decision on a given complaint is final and binding. The decision will be sent to the Participant by email to the address provided in the complaint.
5.4. The Organizer’s decision does not exclude the Participant’s right to pursue claims according to applicable laws.
- 6. PROCESSING OF PERSONAL DATA
6.1. The Administrator of personal data collected in connection with the Campaign is the Organizer: Prosker Sp. z o.o., located in Płock, 09-400 Płock, Tax Identification Number: 774 321 07 15, REGON: 145855516, registered in the National Court Register by the District Court for the capital city of Warsaw in Warsaw, 14th Commercial Division of the National Court Register, KRS: 0000399562.
6.2. The purpose of processing personal data is to conduct the Campaign, as well as to consider any complaints after the end of the Campaign, in accordance with Article 13 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data – General Data Protection Regulation (Official Journal of the EU L 119/1 of May 4, 2016).
6.3. Personal data necessary to receive a reward include the name and surname, phone number, and email address.
6.4. The legal basis for processing personal data of Campaign participants is the consent of the Campaign participant.
6.5. The Participant has the right to access the content of their personal data, to correct it, delete it, limit processing, transfer data, object to data processing, and to withdraw consent at any time without affecting the legality of the processing carried out on the basis of consent before its withdrawal.
6.6. The Participant has the right to lodge a complaint with the supervisory authority.
6.7. The period of processing personal data of Participants who won a Reward in the Campaign will end after five years, counting from the end of the calendar year in which the Campaign period ended (in connection with the obligation to store tax documentation).
6.8. Providing data is voluntary, but it is a necessary condition to participate in the Campaign. Failure to consent to the processing of personal data will result in the inability to receive a Reward in the Campaign.
6.9. Personal data of the Participants will not be transferred to third countries or international organizations.
6.10. Personal data will not be used for making decisions based solely on automated processing, including profiling, which produces legal effects concerning the participant or similarly significantly affects them.
- 7. FINAL PROVISIONS
7.1. The Organizer reserves the right to change these Terms and Conditions, provided it does not affect the rights acquired by the Participants.
7.2. In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply.
7.3. Any disputes arising in connection with the implementation of the Campaign will be settled by the competent common court.
