TERMS AND CONDITIONS OF ‘Dress fabric in nature’ CONTEST

• 1. GENERAL CONDITIONS

1.1 The Terms and Conditions specify the rules for participation in the contest held by Prosker Sp. z o.o. based in Poland, Plock 09-400, Kostrogaj 9D, Tax ID NIP: 774 321 07 15, Business Statistical Number REGON: 14585516, on contest pages (‘Contest pages’):

www.facebook.com/CottonBeePolska, www.facebook.com/CottonBeeFabrics, www.facebook.com/CottonBeeDeutschland. 

1.2. The Terms and Conditions use the following phrases: 

1) Contest – ‘Dress fabric in nature’ contest held by Prosker Sp. z o.o.; 

2) Contest task – a task that needs to be done in order to participate in the contest; 

3) Participant – a person who fulfils the requirements specified in the The Terms and Conditions; 

4) Organiser – Prosker Sp. z o.o. that organises the contest (hereinafter referred to as CottonBee); 

5) Winners – participants who do the contest task according to the rules referred to in par. 3. 

1.3. The Contest will be held between 28th February to 13th March 2024. 

1.4. To become a Participant of the Contest, individuals do the task specified in the contest post (‘Contest post’) on the Contest pages account as well as referred to in par. 3. 

1.5. Participation in the Contest amounts to acceptance of the Contest conditions specified in the Terms and Conditions, including the consent to customer’s personal data processing by the organiser in matters of and basing on principles specified in the Terms and Conditions. 

1.6. The Contest is not sponsored, supported, managed, held by or related to Instagram, Inc. and Facebook, Inc. 

1.7. Instagram Inc. and Facebook, Inc. are not responsible for the correct course of the Contest. All claims concerning the contest should be directed only to the Organiser. 

• 2. PARTICIPATION IN THE CONTEST

2.1. The participants are informed about the participation rules and its course by the Organiser in the Terms and Conditions as well as in Contest post on Contest Pages. 

2.2. The Participants who enter the Contest accept the rules specified in the Terms and Conditions. 

2.3. The participation in the Contest is voluntary and free of charge. 

2.4. The Contest is open only to natural persons domiciled in the territory of European Union who are 18 years of age. Minors (over the age of 16) or incapacitants can partially participate in the contest only upon the consent of their parent or legal guardian. 

2.5. CottonBee employees and other people directly or indirectly related to organisation of the Contest are not eligible to participate in it. 

2.6. The Participants who give false or incorrect personal information or volunteer other persons to participate in the Contest are not eligible to receive a prize. 

2.7. In case the Participants don’t fulfil any of the requirements specified in the Terms and Conditions, they are excluded from the contest and loose the potential right to win the prize. 

2.8. The winner of the Contest consents to the publication of his or her name and surname on post announcing Contest results on the Contest Pages. 

• 3. COURSE OF THE CONTEST

3.1. The Contest task is to take a photo (‘Contest photo’) showing the Participant with his handmade clothes inspirated by nature and publishing it on his private (public) profile on the Instagram or Facebook and tagging the photo with the hashtag #GreenCottonBee. 

3.2. Each Participant is allowed to submit only one entry in the Contest. 

3.3 The Participants who impersonate third parties in order to improve the chance of success in the Contest or persons who copy and use the work and image of third parties especially for the aforementioned reason, are automatically withdrawn from participation in the Contest and their data is blocked in future Contest held by the organiser. 

3.4. Contest entries including expressions and phrases commonly recognised as offensive and insulting or infringing assets and rights of third parties are not taken into account. 

3.5. The three Participants who according to the Organiser, will do the Contest task in the most interesting and inspirational way will be chosen as Winners. 

3.6. The Contest results will be announced on Contest pages by 20th March 2024. 

3.7. Participation in the Contest amounts to the statement of having the copyright to the given photo, not violating the rights of third parties and that the photo has never been published before. 

3.8. The Participant whose entry consists of an image of oneself agrees for public sharing of the photo for the purpose of the Contest. In case the Participant’s entry consists of images of others, the Participant must have consent for public sharing of the images from those parties. 

3.9. The Winner of the Contest grants the Organiser a non-exclusive license under intellectual property rights, to use the Contest photo as a means of promotion of the CottonBee brand in any form and medium for an indefinite period of time. The Organiser may call upon the Winner to sign a copyright transfer agreement regarding the Contest photo. 

• 4. PRIZE

4.1. The prize for each of the 5 Winners of the Contest is a blanket with any design printed on fabric in CottonBee; 

4.2. The winners will be informed by the Organiser of the Contest about its results in private message and on the Contest Pages in a separate post dedicated to the Contest results. 

4.3. The winners are obliged to send an email including a name, surname, telephone number and address required for shipping a prize. The aforementioned information should be sent as a private message on Facebook, Instagram or to [email protected] within 7 days from the date of publishing the contest results. 

4.4. The Organiser of the Contest declares that CottonBee doesn’t take responsibility for not giving a prize in case of incorrect, false or incomplete personal data. 

4.5. The prizes will be sent by the Organiser to the Winners not later than within 15 business days after the date of handling possible complaints. 

4.6. The Participant of the Contest is not allowed to exchange the prize for cash or transfer the right to receive the prize to third persons. 

4.7. The shipping cost of sending the prizes will be covered by the Organiser of the Contest. 

• 5. COMPLAINT PROCEDURE

5.1. Enquiries and complaints concerning the way the Contest is conducted should be directed to [email protected]. The Organiser will deal with complaints sent not later than within 3 days from the date of occurence constituting the cause of complaint. 

5.2. The Participant of the Contest is the only person entitled to submit a complaint. 

5.3. Complaints will be dealt with by the organiser within 3 business days from the date of receiving them. Decision concerning a complaint is final and binding. It will be send to the Participant by email to the given address. 

5.4. The Organiser’s decision doesn’t influence the participant’s right to redress in accordance with applicable law. 

• 6. PROCESSING OF PERSONAL DATA

6.1. The controller of personal data collected in connection with the Contest is the Organiser: Prosker Sp. z o.o. based in Poland, Plock 09-400, Kostrogaj 9D, Tax ID NIP: 774 321 07 15, Business Statistical Number REGON: 14585516, entered into the National Court Register maintained by the District Court for the Capital City of Warsaw, under KRS number: 0000399562. 

6.2. The reason for personal data processing is conducting the Contest, including prize shipping as well as handling possible complaints after the end of the Contest, in accordance with Article 13 of Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data – General Regulation on the Protection of Personal Data (journal of Laws Dz.U. EU No.119 item 1 of 4 May 2016). 

6.3. Personal data necessary for obtaining the prize include a name and surname, telephone number and shipping address. 

6.4. The legal basis for processing the participants’ personal data is consent of the Participant. 

6.5. The Participants has the right to access the Content of their personal data, its correction, removal, restriction of processing, data transfer, object against data processing and withdrawal of Consent at any time without affecting the lawfulness of processing based on consent before its withdrawal. 

6.6. The participant has the right to lodge a complaint with a supervisory authority. 

6.7. Personal data may be transferred to the shipping company for the purpose of sending the prize. 

6.8. Period of processing personal data of the Participants who win the prize in the Contest will finish after five years from the end of the calendar year in which the period of Contest duration is ended (in the obligation to store tax documentation). 

6.9. Data submission is voluntary, but necessary for participation in the Contest. Not giving a consent to the processing of personal data will result in deprivation of an opportunity to get the prize in the Contest. 

6.10. Participants’ personal data will not be transferred to third countries or international organisations. 

6.11. Personal data will not be used for making a decision which is based only on automatic processing including profiling and produces legal effects concerning the Participant or similarly significantly affects them. 

• 7. FINAL PROVISIONS

7.1. The Organiser reserves the right to make changes in this regulation if it doesn’t affect acquired rights of the Participants. 

7.2.In the areas not covered by this regulation Polish law shall apply. 

7.3. Any disputes that may arise concerning the course of contest shall be settled by the proper court.
